The 3rd Court of Appeals has not yet ruled on the question of whether the private operator of the Texas Lottery is immune from suit, even if it misrepresents the chances for winning a scratch-off game. The appeal is considered an “accelerated” appeal under the law. However, after thirteen months, many lottery players are becoming upset, and in some cases, angry that there has not yet been a ruling.
